Sales Terms and Conditions

Preamble

In these terms and conditions of sale, 'Axón' and 'we' refer to 'Axón Librería, S.L.' and 'you' will mean you, the customer.

These general terms and conditions of sale (hereinafter 'sales terms') govern the legal relationship arising from the purchase and sale processes carried out by you on the website located at the URL axon.es and its owner, Axón Librería, S.L., with tax ID B80790355, registered office at C/ Alfonso XII, 20 - First Floor - 28014 Madrid, and registered in the Madrid Mercantile Registry, Volume 7,565, Book 0, Page 106, Section 8, Sheet M-122398. You accept the sales terms from the moment you use or contract the service or purchase any product. The sales terms will be available on the website at all times, without the need to place an order to access them. This document may be printed and stored by you. Axón may modify the terms; the customer will accept the terms in force at the time of each purchase. Modifications are applicable from their publication on the internet and cannot be applied to previously concluded transactions.

Axón provides you with the email address info@axon.es, so you can raise any questions regarding the sales terms.

1. Placing Your Order

1.1. To place an order, you must be 18 years old and have the capacity to contract.

1.2. You can place an order through our online store at axon.es, by email to axon@axon.es, or by calling the phone number 915 939 999. Orders that arrive through means other than the ones previously indicated will not be accepted.

1.3. To place an order on axon.es, it is necessary to register as a user by filling out the corresponding electronic form before starting the purchase process. Once registered, you can proceed with the purchase process of the product or products added to the cart or browse the website to add new products to it.

1.4. By placing your order, you are making an offer to purchase the products you have selected in accordance with these terms and conditions of sale.

1.5. Once your order is accepted, we will send you a confirmation by email that will also include the order number. The order confirmation will be effective upon its sending. If we are unable to process your order due to an issue, we will contact you by email or phone.

1.6. Once registered and having all the required products in the cart, you proceed with the purchase, reaching the payment method selection screen, shipping methods, and selection of billing and/or shipping information. The accepted payment methods, their conditions, and shipping methods are specified in the following sections of these terms.

1.7. Once the purchase is made, Axón will send customers an email with the order receipt, which will include a summary of the purchase, payment information if applicable, and shipping and billing details.

1.8. Axón will send a physical invoice that will be received with the order. This invoice will be issued in the name of the individual or legal entity that placed the order, so customers must ensure it is done under the correct name. You can also view or download your invoices in PDF format from your customer area on the website in the orders section. The product or products will be shipped according to the shipping method selected by the customer.

2. Prices and Shipping Costs

2.1. The prices applicable to each product and/or service are those indicated on the website at the date of the order, including, if applicable, VAT (Value Added Tax). However, according to Law 37/1992, of December 28, which regulates this tax, the transaction may be exempt or not subject to VAT depending on the country of residence of the buyer and the condition in which they act (business/professional or individual). As a result, in some cases, the final price of the order may differ from the price shown on the website.

2.2. For shipments to the Canary Islands, Ceuta, and Melilla, the customer will be responsible for customs clearance fees and payment of the local tax, IGIC or similar, upon receiving the product.

2.3. For shipments to countries outside the European Union, the customer will bear the costs corresponding to taxes and customs duties specific to each country.

2.4. Shipments to mainland Spain and Portugal are free for orders over 35 €. Orders under 35 € will incur a charge of 3 €. Shipments to the Canary Islands, Balearic Islands, Ceuta, and Melilla will be free using the CORREOS shipping method for orders over 100 €. For orders below that amount, shipping costs will be proportional to the order value and will be shown in the shipping costs section of the shopping cart. For other countries, the rates will be displayed in the shopping cart based on the weight of the items and the destination country.

2.5. Shipping costs to other countries will be borne by the customer and will depend on the weight and destination; the shipping quote will automatically be shown in the shipping cost box in the shopping cart once the destination details are filled in.

3. Payment Methods

3.1. You can pay by the following methods:

  • • VISA, MASTERCARD, AMEX Credit/Debit Card
  • • PayPal
  • • Cash on Delivery (Only in Spain)

3.2. If you pay by credit card, you will need to provide your card details when placing your order. We only accept payments with secure cards where identity authentication is carried out according to the method established by your bank through the secure e-commerce service.

3.3. If you choose cash on delivery, you must pay the total invoice amount upon delivery of the goods, plus a 3€ management fee. If you choose two deliveries when placing the order, you will need to pay 3€ in management fees for each delivery, but the total fee will be charged on the first delivery, i.e., 6€ for the first delivery and no fee for the second delivery.

3.4. The maximum amount accepted for cash payments will be 1,000€.

4. Delivery of Your Order

4.1. We will send your order to the shipping address provided in your order request.

4.2. We will ship your order within the shipping period indicated on our website at the time of your order confirmation.

4.3. You can choose, when placing the order, to receive it in a single shipment, or in a first shipment the products we have in stock, and in a second shipment the remaining products. The two-shipment option is only available for Spain and will not be offered for other countries.

4.4. You may cancel your order at any time before it is shipped by sending an email to pedidosweb@axon.es with your order number.

4.5. When our carrier takes charge of your order, we will send you a shipping confirmation via SMS to the phone number you provided when placing the order.

4.6. Deliveries are made within two (2) to three (3) business days for standard shipping via Correos and collection at Correos office for mainland Spain and the Balearic Islands, and seven (7) to ten (10) business days for the Canary Islands, Ceuta, or Melilla. For messenger deliveries, it will be twenty-four (24) hours for mainland Spain and twenty-four (24) to forty-eight (48) hours for the Balearic Islands and Portugal.

4.7. The ownership and risk of loss of the products in the order will transfer to you upon delivery of the order.

4.8. For shipments to the Canary Islands, Ceuta, Melilla, and countries outside the EU, customs clearance fees, as well as payment of the local tax, will always be borne by the customer. If the customer rejects the order upon delivery and it is returned to Axón by the carrier, any customs fees, local taxes, and shipping costs incurred, if any, will be deducted from the refund.

4.9. Please note that the delivery times mentioned in point 4.6 apply to products marked as “In stock” on the online store. For other products, you must add the dispatch times notified on each product page: “Receive it within 3-4 days,” “Receive it within 7-10 days,” “Receive it within 2-3 weeks,” “Receive it within 3-6 weeks,” “Receive it within 6-12 weeks.”

4.10. Orders are accepted 24 hours a day, 365 days a year, but orders placed after 5:00 PM will not be processed until the next business day in Madrid. Orders placed on Saturdays and Sundays will be processed first thing on the following Monday, or the next business day. Orders placed on national holidays and local holidays in the Madrid community will be processed on the next business day.

5. Satisfaction or Return. Right of Withdrawal

5.1. You will have a period of 14 calendar days from the receipt of the goods to resolve the contract.

5.2. The returned order must be delivered along with the invoice, and you will bear the return costs. You can return any item you have purchased, as long as the products retain their original seal or packaging and the manuals, accessories, or promotional gifts, if applicable, otherwise the item will suffer depreciation. The customer will only be responsible for the decrease in value of the goods resulting from handling them in a way other than what is necessary to establish their nature, characteristics, or functioning.

5.3. If a product different from the one you ordered is delivered by mistake on our part, we will deliver the correct product and collect the first one, at no additional charge to you.

5.4. If you receive a broken, damaged, or defective product, we will take care of picking it up from your home and replacing it with a new one at no extra charge.

5.5. You cannot return a product and claim a refund if it is a personalized item. Products such as unsealed computer software, eBooks that have had the provided code redeemed, or printed books containing online access with a code that has been used cannot be returned. Similarly, health or hygiene-sensitive products that have been unsealed cannot be returned.

5.7. To proceed with the return of any product, you must complete the form that will appear by clicking the following link RETURNS. The form is an email format that, once filled out with the requested data, will be sent to the address pedidosweb@axon.es, and you will receive a response indicating whether the return is accepted and the steps to follow for processing it.

5.8. As long as the products are returned to us undamaged, with the invoice copy and the authorization number we have provided, we will refund the amount paid for the returned products. The return shipping costs will be borne by the customer. If you decide to use Axón's reverse logistics services, we will send you the instructions and the costs will be deducted from the refund amount. If you return the product by your own means, we will be responsible for the condition of the product once we receive it at our warehouse. In this case, the refund will be for the value of the returned products.

5.9. In the case of returns from the Canary Islands, Ceuta, Melilla, and countries other than Spain, in addition to the return shipping costs, the customs clearance fees and local taxes, if any, will be borne by the customer.

5.10. Without affecting the consumer's right of withdrawal or liability for defective products, our civil liability for the supplied products will be limited to their amount.

5.11. In the event of a return, the refund of the amounts paid will be made via bank transfer.

5.12. Axón will not refund the amount or resend merchandise until the receipt and condition of the packaging and accessories of the returned or exchanged product have been verified in our warehouse.

5.13. If, upon receiving the package, you notice that the box is defective or believe it may have been tampered with, you must not accept the package and contact us immediately. If you have accepted it and the package was damaged or tampered with, you must contact us within 48 hours to proceed with the claim with the carrier company by emailing pedidosweb@axon.es or calling the phone number: 911 390 066, from 9:00 AM to 3:00 PM, Monday to Friday.

6. Warranty

6.1. All products available for purchase on axon.es come with a legal warranty of two (2) years from the delivery date. Each manufacturer may have a warranty period that may, in some cases, exceed 2 years.

6.2. In case of a defective product, Axón must proceed, as appropriate, with repair, replacement, price reduction, or contract termination, all of which will be free of charge for you, the consumer and user. Axón is responsible for any lack of conformity that becomes apparent within two (2) years from delivery to the user or consumer. You must notify Axón of any lack of conformity within two (2) months from the moment you became aware of it.

6.3. If, after reviewing the product, no defect is found or the issue is not covered by the warranty, Axón may charge you for the shipping costs of the handling process, both for the outbound and return shipments.

6.4. The shipping costs for warranty handling are covered within the territories of mainland and island Spain and mainland Portugal. Outside of these territories, you will be responsible for the shipping costs both for outbound and return shipments.

When contacting us regarding an order you have placed, you should provide your order number.

8. Content and Information Provided on Our Website

8.1. Axón reserves the right to modify the commercial offer presented on the axon.es website (modifications to products, prices, promotions, and other commercial and service conditions) at any time.

8.2. Axón makes all reasonable efforts to ensure that the information displayed on its website is accurate and free of typographical errors. If such an error occurs, which is at no time intentional by Axón, it will be corrected immediately once detected. If the error occurs in any of the prices displayed and a customer has made a purchase, we will inform the customer of the error, and the customer or user will have the right to cancel their order at no cost to them. The sending of an automatic purchase confirmation does not validate the conditions of an erroneous price.

8.3. Axón obtains the features and descriptions of products offered on the website from information provided by editors, manufacturers, and distributors, and in some cases, from their own websites. If the product information does not match the actual features, the customer can cancel the order at no cost to them.

8.4. The information presented on the website is in Spanish, including the formalization of the contract and all contractual information displayed and sent to consumers or users.

9. Data Protection

By placing an order, the customer agrees to the processing of their personal data provided by them, by Axón, through the express acceptance of the Privacy Policy

10. Force Majeure

We will do everything possible to fulfill the obligations arising from your order. However, we will not be liable for delays or non-compliance if the delay or non-compliance is due to force majeure. In case of delay, we will fulfill our obligations as soon as reasonably possible.

11. Applicable Law and Jurisdiction

These terms and conditions are governed by Spanish law. The parties submit, at their choice, to the courts and tribunals of the Community of Madrid for the resolution of conflicts, waiving any other jurisdiction.

12. Nullity and Ineffectiveness of the Clauses

If any clause included in these terms and conditions is declared, in whole or in part, null or ineffective, such nullity or ineffectiveness will affect only that provision or the part of it that is null or ineffective, with the rest of the terms and conditions remaining in full force, and such provision, or the affected part of it, will be considered as not written.
